Our Services

The Real Estate Department exists for the purpose of serving our local churches and pastors of the Apostolic Assembly with assistance on all real estate matters.

Why is this necessary and important?

All properties owned and leased within the Apostolic Assembly are under the legal custodianship of the corporation. This means that all sales, purchases, refinances, leases, subleases, and other real estate transactions are legally bound to the Apostolic Assembly.

Our department specializes in managing these transactions and providing a variety of services to our local churches. We provide the following services:

Consultations
The Real Estate Department provides free consultations to pastors of the Apostolic Assembly who are considering a real estate transaction. Real Estate transactions can include:

    • Sales
    • Purchases
    • Refinances
    • New Construction
    • Building Repairs and Improvements
    • Cash Out Loans
    • Leases
    • Subleases
    • Month-to-month verbal leases
    • Property Taxes
    • Mortgage Management

Any type of transaction that will affect the building, or property, in any way should be communicated with the Real Estate Department. The purpose of the consultation is to help the local church determine if the desired transaction is possible and if it meets the constitutional requirements.

Processing Resolutions
When a local church has decided to move forward with a Real Estate transaction, the church must follow the Resolution Process in order to receive the legal authorization to complete the transaction.

No real estate transactions can be decided, or approved, by an individual. All transactions must be approved on three separate levels through the resolution process. They are:

    • The Local Church Resolutions – approval from the majority of the local church
      • Local Government Resolution
      • Local Member Resolution
    • The District Resolution – approval from the District General Board
    • The Corporate Resolution – approval from the General Board of Directors

Along with the legal resolution documents, all supporting documentation must be included and presented to each level before a Corporate Resolution can be approved. If a resolution is not approved at any level, then it cannot be advanced to the next level of approval.

The Real Estate Department assists and guides the local church throughout the entire Resolution Process to ensure that all legal guidelines are followed, and that the resolution is accurate and complete.

Property Taxes –
It is the responsibility of the local church to apply for property tax exemption annually. However, the Real Estate Department works with the local church to ensure that property taxes are paid and that the church has applied for exemptions on eligible properties. Property Tax laws and regulations vary from state to state. The Real Estate Department is equipped to assist local churches in each state with their property tax needs and to communicate on behalf of the church with County and State officials.

If a local church is having trouble paying its property taxes or is unsure of the exemption status, they may contact the Real Estate Department for assistance. Services we provide for property tax management include:

    • Exemption Applications
    • Appeals
    • Property Tax Payments Notices

Property Management
Every property requires regular maintenance, repairs, improvements, and regulatory management over time. Although minor maintenance and repairs are the responsibility of the local church, the Real Estate Department provides support and oversight for major property management issues that may arise.

The General Rule is that any maintenance, repair, or improvement that requires a loan, a structural modification, a city approval, or the acquisition of a permit must be communicated with the Real Estate Department.

Additionally, any type of regulatory actions that must be performed such as Fire Code Compliance, Health Code Compliance, or addressing any violations must be communicated with the Real Estate Department. It is important to note that when dealing with violations imposed by the city, or a governing municipal agency, the violations must be addressed and corrected in order to prevent a lien, or penalty, from being filed against the property.

The Real Estate Department is prepared to assist the local church with any property management issues that may arise.

Property Management issues can include:

    • Addressing violations
    • Addressing title issues
    • Addressing liens
    • Oversight of major repairs and improvements
    • Easement requests and installations
    • Paying for city bills and/or fines
    • Handling communications received by municipal authorities
    • Assisting with property zoning issues and replats

Loan Management
All properties purchased and owned by any local church should name the Apostolic Assembly as the legal Borrower. This means that our department is responsible to manage each individual loan for the duration of the loan. Loan Management includes:

  • Receiving and processing monthly mortgage statements
  • Working to build strategic partnerships with lending institutions
  • Processing refinances before loan maturity
  • Assisting churches with acquiring favorable interest rates
  • Assisting churches with financial hardships
  • Acting as a liaison between the churches and the lenders
